Terms
These terms apply to the Potato Mart Wholesale storefront, trade applications and accounts, commercial orders, payment, delivery or collection, returns, liquor, and support.
English is the controlling legal version.
By using the wholesale storefront, applying for an account, or placing an order, you agree to these terms and the policies linked from the storefront. If you act for a business, you confirm that you are authorised to provide its information, manage its account, and place orders on its behalf.
You must provide accurate and current business, contact, delivery, and account information, keep login details secure, restrict access to authorised users, and tell us promptly if you suspect unauthorised use. We may assess, approve, restrict, suspend, or close access where reasonably required for account administration, security, risk, legal compliance, or misuse.
We aim to keep product names, images, pack details, storage information, catalogue status, and availability accurate, but information may change and errors may occur. Images are illustrative. If a characteristic is important for your business, confirm it with us before ordering and check the product label when the goods arrive.
Protected prices are commercial prices for the signed-in trade account and are shown in Australian dollars unless stated otherwise. Account pricing, volume arrangements, specials, coupons, vouchers, taxes, minimum quantities, expiry dates, stock limits, and other eligibility conditions may apply. We may correct a clear pricing or promotion error and contact you if an order is affected.
Submitting an order is an offer to buy the selected goods on the displayed and account-specific terms. We may accept, refuse, cancel, or limit an order for stock, safety, pricing error, supply, fraud prevention, credit risk, legal compliance, or service availability reasons. We will notify the account contact when reasonably practicable if an order is materially affected.
You must pay amounts when required by checkout, invoice, or the written payment terms approved for your trade account. Payment records may take time to reconcile. Credit limits, payment timing, accepted methods, and other commercial arrangements communicated for your account form part of these terms.
Available delivery or collection options depend on the account, location, order, stock, operating hours, carrier capacity, weather, and public holidays. Dates and time windows are estimates unless we expressly agree otherwise in writing. You are responsible for accurate contact, access, and delivery information and for ensuring an authorised person can receive the goods.
You must collect or receive chilled, frozen, short-dated, or perishable goods promptly, inspect them on arrival, and store and handle them according to the product label and appropriate food-safety practices. Tell us promptly if goods arrive damaged, unsafe, at the wrong temperature, or materially different from the order.
Contact us promptly if you need to change or cancel an order. We may not be able to change or cancel goods that have been sourced, allocated, packed, dispatched, delivered, collected, or otherwise fulfilled. Any available cancellation outcome may depend on the goods, fulfilment stage, and rights that cannot be excluded by law.
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. Where those guarantees apply, you may be entitled to a repair, replacement, refund, cancellation, or compensation depending on the circumstances. Nothing in these terms limits a right or remedy that cannot lawfully be limited.
Unless required by law or agreed by us, we are not required to accept a return or provide a credit or refund for change of mind, incorrect selection, excess stock, or a change in your business circumstances. Contact us before returning goods so we can confirm whether a return can be accepted.
Alcohol must not be supplied to or purchased by anyone under 18. We may require evidence of age, identity, business authority, or lawful receipt, and may refuse or cancel alcohol orders where licensing, delivery, safety, or other legal requirements are not met.
You must not misuse the storefront, interfere with its operation or security, attempt unauthorised access, introduce malicious code, scrape content at scale, misrepresent your identity or authority, or use the storefront or its content for unlawful activity.
The storefront content, branding, images, layouts, and text are owned by Potato Mart or licensed to us. You may use the storefront for genuine wholesale purchasing and account administration, but must not copy, publish, sell, or reuse its content except with permission or as allowed by law.
Nothing in these terms excludes liability or rights that cannot be excluded under Australian law. To the extent permitted by law, Potato Mart is not liable for indirect or consequential loss, loss caused by inaccurate information or instructions you provide, or delay or failure caused by events outside our reasonable control.
Written pricing, credit, delivery, supply, or other commercial terms approved for your trade account also apply. If those written account-specific terms are inconsistent with these general terms, the account-specific terms apply to the extent of the inconsistency, unless the law requires otherwise.
We may update these terms when our services, practices, or legal obligations change. The version published on the storefront applies from its stated publication date. Terms already agreed for an accepted order continue to apply to that order unless the parties agree otherwise or the law requires otherwise.
Contact us with the account or order details and a clear description of the issue so we can review it. We will try to resolve concerns directly and reasonably. This process does not prevent either party from exercising rights or remedies available under applicable law.
